Terms and Conditions for FRESHIYO
Welcome to FRESHIYO! These Terms and Conditions ("Terms") govern your use of the FRESHIYO mobile application and services.
FRESHIYO is a brand operated under and owned by EARTH'S PANTRY, a proprietary company. Throughout the app and these Terms, the terms "we," "us," and "our" refer to EARTH'S PANTRY. By accessing or using our app, you agree to be bound by these Terms.
1. Acceptance of Terms
By downloading, installing, or using the FRESHIYO mobile application, you agree to comply with and be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the application.
2. Eligibility
You must be at least 18 years of age to use this app. By using FRESHIYO, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.
3. Account Registration
To place an order, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate, current, and complete information during the registration process. EARTH'S PANTRY reserves the right to suspend or terminate accounts that provide false information.
4. Services and Pricing
FRESHIYO provides an online platform for the purchase of vegetables, fruits, and groceries. All prices listed are in the local currency and are inclusive of applicable taxes unless stated otherwise. While we strive for accuracy, errors in pricing or product descriptions may occur. In such cases, we reserve the right to cancel orders placed at an incorrect price.
5. Ordering and Delivery
FRESHIYO services are limited to specific geographic areas as defined within the app. We aim for rapid delivery, similar to quick-commerce models, but delivery times are estimates and not guaranteed. Applicable delivery fees will be displayed at checkout. You or a designated person must be available to receive the order at the delivery address provided.
6. Returns, Refunds & Cancellations
Returns and refunds are handled as follows:
- Orders can only be cancelled before they are dispatched. Once an order is out for delivery, cancellations may incur a fee.
- Due to the nature of fresh produce (fruits and vegetables), returns are only accepted at the time of delivery if the items are damaged or of poor quality.
- Approved refunds will be processed to the original payment method or as app credit within 5–7 business days.
7. Intellectual Property Rights
All content on the FRESHIYO app, including logos, text, graphics, and software, is the property of EARTH'S PANTRY. All rights, titles, and interests in and to the brand "FRESHIYO" and its operations are reserved by EARTH'S PANTRY. Users are prohibited from copying, modifying, or distributing any part of the app without explicit written consent.
8. Limitation of Liability
EARTH'S PANTRY shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the FRESHIYO app. We do not guarantee that the service will be uninterrupted or error-free.
9. User Conduct
You agree not to use the app for any fraudulent or unlawful purposes, attempt to bypass any security measures of the application, or interfere with the delivery partner's ability to perform their duties.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where EARTH'S PANTRY is registered.
11. Changes to Terms & Contact
EARTH'S PANTRY reserves the right to modify these Terms at any time. Continued use of the FRESHIYO app after changes are posted constitutes your acceptance of the new Terms.
